Terms of Service

By accessing or using the OrchStack website, the design partner program, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

OrchStack provides this website, the OrchStack design partner program, and OrchKernel. OrchKernel is self-hosted software: you run it on your own infrastructure, with the model providers you choose.

OrchKernel is source-available under the Business Source License 1.1. Your use of the OrchKernel software is governed by that license, not by these Terms. Where the two conflict, the license applies to the software.

Participation in the design partner program may be subject to a separate written agreement with OrchStack. We may change, suspend, or end any part of the website or the program with reasonable notice.

When you apply to the design partner program or contact us, you must give accurate information. You are responsible for any credentials we issue to you and must tell us promptly of any unauthorized use.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the Service to build agents that generate illegal, harmful, or deceptive content, engage in spam or phishing, infringe intellectual property rights, or violate the privacy of others.

You may not attempt to gain unauthorized access to the Service or the infrastructure behind it. What you may do with the OrchKernel source code is set by its license.

The Service, including all software, designs, text, graphics, and other content, is owned by OrchStack and protected by intellectual property laws. These Terms do not grant you any rights to OrchStack trademarks, logos, or other brand features.

You retain all rights to your data and to the content you create or configure in OrchKernel, including agent definitions, playbooks, rules and company knowledge. A self-hosted OrchKernel deployment keeps that data on your infrastructure.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. OrchStack does not guarantee that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

To the maximum extent permitted by law, OrchStack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the Service.

You may stop using the Service or leave the design partner program at any time by telling us. On request, we will delete the information you gave us through the website or the program.

OrchStack may suspend or terminate your access to the Service at any time if you violate these Terms or engage in abusive behavior. We will provide reasonable notice before termination except in cases of serious violations.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Delaware.
